To ensure that this Camp has publicness (is accepted by public) and provides a safe and comfortable stay to guests, the following rules need to be followed: Not abiding by these rules may lead to cancellation of stay and/or refusal to use the camp's facilities.
Further, if you happen to damage any equipment or fixtures inside the camp's premises, the camp reserves a right to charge you the full cost of the same.
1. Scope & Reservation Integrity:
1.1 Binding Accord: By reserving a stay, commissioning a seasonal journey, or utilizing any services provided by The NAPA Sanctuary & Foundation ("NAPA," "we," "us," or "our"), the guest ("Patron," "you," or "your") explicitly accepts these Terms & Conditions.
1.2 Sanctuary Allocations: Reservations across all architectural tiers—including The Horizon Ridge Suite, The Mara Canopy Suite, and The NAPA Family Legacy Pavilion - are subject to availability and strict environmental capacity limits designed to preserve ecosystem integrity.
2. Deposit, Payment, & Guarantee Policy
2.1 Booking Guarantee: A non-refundable deposit of 30% of the total residency fee is required at the time of reservation to secure your sanctuary footprint and dedicated naturalist allocation.
2.2 Final Settlement: The remaining 70% balance must be settled no later than 60 days prior to your scheduled arrival date. For bookings initiated within 60 days of arrival, full payment is required immediately upon confirmation.
2.3 Currency & Transaction Fees: All transactions are processed in United States Dollars (USD). The Patron is responsible for any intermediary bank charges, wire fees, or foreign currency conversion costs incurred during transfer.
3. Cancellation, Rescheduling, & No-Show Terms
We operate on an exclusive, low-impact model with strictly limited guest capacity. Cancellations directly impact our frontline conservation operations.
3.1 Cancellation Timeline & Penalties:
- More than 60 days prior to arrival: The 30% deposit is retained; remaining funds are refunded.
- Up to 30 days prior to arrival: 50% of the total residency fee is retained.
- 29 days or fewer prior to arrival/No-Show: 100% of the total residency fee is retained; no refunds will be issued.
3.2 Rescheduling Flexibility: Requests to adjust stay dates are subject to availability, seasonal rate shifts, and sanctuary approval. Date changes requested within 60 days of arrival may incur administrative fees.
3.3 Mandatory Travel Insurance: All guests must obtain comprehensive international travel insurance prior to departure. Insurance must cover trip cancellation, emergency medical evacuation, medical expenses, loss of personal property, and travel disruptions.
4. Ecosystem & Wildlife Protocol
4.1 The Primal Environment: The NAPA Sanctuary is situated within an unfenced, wild ecosystem home to dangerous wildlife. While our naturalists, trackers, and security staff operate with extreme vigilance, all guests enter the environment with an understanding of its inherent, unscripted risks.
4.2 Guided Operations: Guests must strictly follow all instructions provided by NAPA naturalists, Maasai guides, and sanctuary staff. Walking unescorted outside designated suite perimeters or after dusk is strictly forbidden.
4.3 Wildlife Respect & Code of Conduct: Harassment of wildlife, unauthorized feeding, off-road driving outside permitted conservation zones, or disruptive behavior during field tracking will result in immediate termination of the safari without refund.
5. Aviation, Transfers, & Charter Logistics
5.1 Bush Airstrip Operations: Aircraft transfers connecting Wilson Airport (WIL) or regional hubs to the NAPA Private Airstrip are subject to weather, air traffic control clearance, and strict luggage limits set by aviation partners.
5.2 Luggage Constraints: Standard light-aircraft transfers enforce a strict luggage limit of 15 kg (33 lbs) per guest, packed in soft-sided duffel bags. Hard-shell suitcases may require private charter upgrades or separate transport at the guest's expense.
6. Community Accords & Sovereign Cultural Respect
6.1 Cultural Integrity: NAPA operates in sovereign partnership with local Maasai community leadership. Guests participating in Maasai Campfire & Storytelling, cultural visits, or boma dialogues are expected to conduct themselves with absolute cultural respect and humility.
6.2 Photography Protocols: Filming or photographing community members, sacred rituals, or traditional bomas requires explicit prior consent from community elders or your guiding naturalist. Commercial photography or drone usage requires formal permits from NAPA management and wildlife authorities.
7. Wellness & Somatic Therapies
7.1 Physical Disclosures: Prior to undertaking treatments at Spatial Restoration: Spa & Wellness or participating in somatic plunge therapies, guests must disclose pre-existing medical conditions, physical injuries, cardiovascular conditions, or botanical allergies via our Somatic Intake Profile.
7.2 Practitioner Discretion: NAPA practitioners reserve the right to alter or decline specific hydrotherapy or thermal treatments if deemed unsafe for the guest's health state.
8. Liability & Force Majeure
8.1 Limitation of Liability: To the maximum extent permitted by applicable law, The NAPA Sanctuary & Foundation, its directors, employees, and community partners shall not be liable for any direct, indirect, incidental, or consequential loss, injury, illness, death, or property damage occurring during your stay or transit, except in cases of proven gross negligence by NAPA.
8.2 Force Majeure Events: NAPA is not liable for failures, delays, or cancellations caused by acts of God, extreme weather phenomena, flood, fire, civil unrest, government restrictions, closed airspace, severe river line surges, or unexpected wildlife migrations disrupting access. In such events, NAPA will work with guests to reschedule stays where feasible.
9. Governing Law & Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Kenya. Any legal disputes, claims, or proceedings arising out of or in connection with your stay at NAPA shall be submitted exclusively to the jurisdiction of the courts of Nairobi, Kenya.
